  1. Intellectual Property

This site belongs to Kela and is operated by Kela. The presentation and each of the elements, including trademarks, logos and domain names appearing on the Kela site (hereinafter “the Site”), are protected by the laws in force on intellectual property and belong to Sanofi or its subsidiaries, or are used under authorization. No element making up the Site may be copied, reproduced, modified, republished, uploaded, distorted, transmitted or distributed in any way, on any medium whatsoever, in whole or in part, without the prior written authorization of Kela, except for strictly press-related use and subject to compliance with intellectual property rights and any other proprietary rights mentioned. Only copying for private use is authorized for your personal, private and non-commercial use on your personal computer. The following notice must appear on any authorized copy of all or part of the Site content: “COPYRIGHT ©Kela. ALL RIGHTS RESERVED.” Any authorized use of the elements making up or appearing on the Site must be made without distortion, modification or alteration in any way whatsoever. Sanofi or its subsidiaries reserve the right to prosecute any infringement of their intellectual property rights.

Kela cannot be held liable for any third-party site that you may access through the Kela.fr website. We have no means of controlling the content of these third-party sites, which remain entirely independent of Kela. Furthermore, the existence of a link between the Site and a third-party site does not in any way mean that Kela approves, in any capacity whatsoever, the content of that site or, a fortiori, any use that may be made of it. In addition, it is your responsibility to take the necessary precautions to avoid any contamination of the Site, in particular by one or more viruses, Trojan horses or any other harmful elements. External sites may contain hyperlinks pointing to the Site. Such a link may not be created without Kela’s prior and express agreement. In any event, Kela is in no way responsible for the unavailability of such sites, and Kela does not review, control, approve or assume responsibility for the content, advertising, products or other elements available on or through these sites.

3.1 Kela will not disclose to third parties any personal data concerning you that you may communicate to it by e-mail. It will be used only for the purpose of responding to you as efficiently as possible. In accordance with laws relating to the protection of individuals with regard to the processing of personal data, you have the right to access, modify, rectify and delete personal data concerning you. 3.2 The Site is not intended to receive confidential information from you. Accordingly, with the exception of the personal data referred to above, any information, in whatever form—document, data, graphic, question, suggestion, concept, comment or otherwise—that you communicate to us on the Site will under no circumstances be treated as confidential. Accordingly, its mere transmission by you gives us the right to use, reproduce, distribute, modify or transmit it for the purpose of processing your request.

Protection and Processing of Personal Data

This site respects internet users’ privacy and complies with the laws in force on the protection of privacy and individual freedoms. Personal information concerning you may be collected during your visit, in particular:

  • When you post a comment: the site stores your e-mail address, the name or pseudonym you provide, and your IP address;
  • When you send a message via the contact form: the site stores your e-mail address, the name or pseudonym you provide, and your IP address;
  • When you ask to be notified by e-mail of a reply to your comment: the site stores your e-mail address and your notification preference;
  • When you browse the site, because Kela uses the Google Analytics statistics tool to collect anonymous information about your browsing;

How is this data secured? All information that you explicitly send through the site (comments, forms, etc.) is stored on the secure servers of the hosting provider whose contact details appear at the bottom of this document. You can learn more about the infrastructure by visiting my hosting provider’s website. The newsletter is managed by the MailerLite service. It requires a double opt-in : in other words, you must confirm your e-mail address before you begin receiving the newsletter, in order to prevent a third party from subscribing you without your knowledge. How is this data processed? When you send information using a form (comments, contact form), the site publisher is the sole recipient. This personal data will under no circumstances be resold to third parties and is used exclusively for the purpose initially intended (e.g.: if you provided your e-mail address in the contact form, it will be used exclusively to provide you with a response). Personal data collected by Google Analytics is retained for 14 months. Data collected through the newsletter is retained for the entire duration of your subscription to the newsletter, and an unsubscribe link appears in every e-mail you receive. Data appearing in comments is retained throughout the lifetime of the Kela site. Finally, data sent via the contact form is retained for one year, the time needed to provide you with a response and keep a history of exchanges if necessary. In accordance with the provisions of French Law No. 78-17 of January 6, 1978 relating to information technology, files and civil liberties, internet users have the right to access, modify, rectify and delete data concerning them. You may exercise this right through the site’s contact form. In addition, when you first connect, the Kela blog displays an information banner warning you that cookies are used on the site to collect statistics and display targeted advertising.

  1. Limitations of Liability

Kela makes every effort, to the best of its ability, to ensure the accuracy and updating of the information published on the Site, the content of which it reserves the right to correct at any time and without prior notice. However, Kela cannot guarantee the accuracy, precision, updating or completeness of the information made available on the Site. Consequently, and with the exception of direct damages resulting from gross negligence or intentional misconduct by Kela, Kela declines all liability:

  • for any imprecision, inaccuracy or omission relating to information available on the Site;
  • for any damage resulting from fraudulent intrusion by a third party that led to the modification of information or elements made available on the Site;
  • and, more generally, for any damage, direct or indirect, whatever its causes, origins, nature or consequences, even if Kela had been advised of the possibility of such damage, caused by reason of (i) anyone’s access to the Site or inability to access it, (ii) use of the Site, including any deterioration or viruses that may infect your computer equipment or any other property, and/or (iii) reliance placed on any information coming directly or indirectly from the Site.

The elements of the Site or of any other site are provided as is, without any warranty of any kind, whether implied or express. Kela provides no warranty, implied or express, relating, without limitation, to their merchantability or fitness for a particular purpose.

  1. Website Availability

You acknowledge (i) that it is technically impossible to provide the Site free from any defect and that Kela cannot undertake to do so; (ii) that defects may lead to the temporary unavailability of the Site; and (iii) that the operation of the Site may be affected by events and/or elements beyond Kela’s control, such as, for example, means of transmission and communication between you and Kela, and between Kela and other networks. Kela and/or its suppliers may, at any time, modify or interrupt, temporarily or permanently, all or part of the Site in order to carry out maintenance operations and/or improvements and/or modifications to the Site. Kela is not responsible for any modification, suspension or interruption of the Site.

  1. Jurisdictional Provisions

The Site and its content are governed by the laws of Canada, and any dispute relating to them will be submitted to the jurisdiction of the Canadian courts.
